ILL. STATE COURT JUDGE GRANTS MTD IN HUNSTEIN CASE
- In a case defended by the team at Martin Lyons Watts Morgan, a state court judge in Illinois has granted a defendant’s motion to dismiss a Fair Debt Collection Practices Act case over the use of a vendor to print and mail collection letters. This is the second different state court judge to rule that Hunstein cases are not the type of communications that the FDCPA was enacted to prevent.

APPEALS COURT AFFIRMS REASONABLENESS OF FCRA DISPUTE INVESTIGATION IN ID THEFT CASE
- The Court of Appeals for the Eleventh Circuit has affirmed a lower court’s ruling that a furnisher performed a reasonable investigation into a consumer’s dispute, even though the charges in question were fraudulent and led to one of the consumer’s employees being charged with multiple felonies.
