Judge Grants MSJ for Defense in FDCPA Case Over Dispute Request
- A District Court judge in Oregon has granted a defendant’s motion for summary judgment in a Fair Debt Collection Practices act case, ruling the plaintiff’s requests when seeking validation of the debt fell outside the scope of what the defendant had to provide and that the defendant did not validate the statute by sending the same information when the plaintiff initiated multiple disputes about the same debt.

CFPB Sues PHEAA For Collecting on Discharged Student Loans
- The Consumer Financial Protection Bureau on Friday announced it had filed a lawsuit against the Pennsylvania Higher Education Assistance Agency (PHEAA), alleging that PHEAA illegally collected on student loans that had been discharged in bankruptcy and provided false information to credit reporting companies. The CFPB is seeking to halt these illegal practices, provide redress to affected borrowers, and impose a civil penalty on PHEAA.

Should You Text Before Calling First?
- Should collectors send text messages to consumers before calling them, letting the consumer know that a phone call is coming? Some collectors are using this strategy and having some success with it. There may be a reason for that.
